For purposes of this Agreement, “Site” refers to the Company’s website, which can be accessed at https://www.superbio.ai. “Service” refers to the Company’s services accessed via the Site, in which users can.
Upload data to our Site from your computer’s local storage or a range of remote storages including Google Drive and AWS S3.
Store, process, clean, edit and view data that either you have uploaded or selected from our open data collection.
Use our “Machine Learning Workstation” to train machine learning models with your data or our open data, and visualize results of said model training.
Apply no-code artificial intelligence based tools in our “App Store” to apply your data.

The terms “we,” “us,” and “our” refer to the Company. “You” refers to you, as a user of our Site or our Service.
1. Information Superbio.ai inc. May Collect From You
Our primary goals in collecting information are to provide AI based biological services to you, to improve our Site, features, content, and to run our business. We collect “Non-Personal Information”, “Personal Information”, and information you voluntarily provide. Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks. Personal Information includes your email, which you submit to us through the registration process at the Site.
Biological Information That You Voluntarily Provide
Superbio.ai inc. collects and stores the biological data (genomic, medical record, medical image, etc.), derived from humans or other organisms, that you submit to the site along with metadata and other information related to such data. In the case of sensitive data (e.g. medical), you agree to and accept full responsibility for obtaining all necessary permissions and informed consent from all parties from which your submitted data is composed of.
HIPAA, Protected Health Information, and the Clinical Compliance Features
Superbio.ai inc. is not a Covered Entity as that term is defined in the Health Insurance Portability and Accountability Act of 1996, as amended, and its related regulations (collectively, "HIPAA"). On occasion, Superbio.ai inc. may agree in writing with a user to perform services for the user in the capacity of a Business Associate under HIPAA. We offer a separate HIPAA Business Associate Privacy Agreement ("BA Privacy Agreement") for HIPAA-regulated users, and we recommend that such users enter into a BA Privacy Agreement with Superbio.ai inc. prior to uploading, storing, or otherwise transferring "protected health information" as defined in HIPAA ("PHI") using the Site.
Users who desire to upload, store, or otherwise transfer PHI using our services must implement all of the required clinical compliance features (“Compliance Features”). The uploading, storing, or transferring of PHI using the services by users that have not implemented the Compliance Features is strictly prohibited. You agree that, unless you have implemented the Compliance Features, you will not upload, store, or otherwise transfer PHI using the services. You acknowledge that this may require you, in some instances, to anonymize PHI prior to uploading it to the services such that the PHI cannot be traced back to an individual. You further agree to indemnify and hold harmless Superbio.ai inc. of and from any and all claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys' fees and costs, arising out of or relating to your uploading, storing, or transferring of PHI without having fully implemented the Compliance Features. Please note that for any personal information we receive which is PHI, Superbio.ai Inc. will be a processor for the purposes of processing this personal information.
User Account Information/Personally Identifiable Information
To activate the Service you do not need to submit any Personal Information other than your email address. To use the Service thereafter, you do not need to submit further Personal Information.
Cookies and Tracking Pixels/Non-Personal Information
In an effort to improve the quality of the Service, we track information provided to us by your browser or by our software application when you view or use the Service, such as the website you came from (known as the “referring URL”), the type of browser you use, the device from which you connected to the Service, the time and date of access, and other information that does not personally identify you. We track this information using cookies, tracking pixels, and other similar technologies. Cookies are small data files that our web servers send to your browser and which get saved on the hard drive of the computer that you are using to access the Site. If you do not want to allow cookies on your computer, most browsers have a feature that allows you either to automatically decline cookies or to decline or accept particular cookies from particular web sites. If you choose to reject cookies from our Site, you may be unable to use certain Site Services, features, and functionality. The Site and the Service are not directed to anyone under the age of 13. The Site does not knowingly collect or solicit information from anyone under the age of 13, or allow anyone under the age of 13 to sign up for the Service. In the event that we learn that we have gathered personal information from anyone under the age of 13 without the consent of a parent or guardian, we will delete that information as soon as possible. 2. How Your Information May be Used
We may use your Personal Information to improve our products and Services, to ensure contact information is up to date and accurate, to improve our customer service, to reduce risk and prevent fraud, to provide you with a personalized experience on our Site and to communicate with you regarding new Service features and related products and services provided by our partners, events, and other information and notices we believe you may find interesting or useful. We will not sell or provide your information to third parties for their own direct marketing purposes.
We use the automatic usage and other non-Personal Information collected to maintain, secure, and improve our Site, and to understand your interests when visiting our Site. We may generate statistical information regarding our user-base and use it to analyze our Site or business.
3. With Whom May Superbio.ai inc. Share Your Information?
We may rely on various third-party service providers and contractors to provide services that support the Site and our operations, including, without limitation, maintenance of our databases, distribution of emails and newsletters on our behalf, data analysis, payment processing and other services of an administrative nature. Such third-parties may have access to your Personal Information for the purpose of performing the service for which they have been engaged.
Compliance with Laws and Law Enforcement
Superbio.ai inc. cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We may disclose Personal Information and other user information when we, in our sole discretion, have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may (either intentionally or unintentionally) be causing injury to or interference with our rights or property, users of our Site, or anyone else who could be harmed by such activities. We may also disclose user information when we believe, in our sole discretion, that such disclosure is required by applicable law. We also may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.
Vendors and Service Providers
We use various third-party service providers, such as AWS and Google Analytics that assist us in providing the Site. We may keep logs of your activity as you use our Services, for example, which pages you visit, when you use the Machine Learning Workstation or App Store, or what calls are made to our API. For example, we may use third-party vendors to store and authenticate account credentials, store and analyze system logs, send email communications, and for hosting and storing information collected through our Site. We may need to share your information with these vendors and service providers to enable them to provide these services to us. These service providers and vendors are required to only use your information to provide their services to us and in a manner consistent with this Policy.
4. How We Protect Information
We implement security measures designed to protect your information from unauthorized access. Your account is protected by your account password and we urge you to take steps to keep your personal information safe by not disclosing your password and by logging out of your account after each use. We further protect your information from potential security breaches by implementing certain technological security measures including encryption, firewalls and secure socket layer technology. However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. By using our Service, you acknowledge that you understand and agree to assume these risks.
5. Links and Third Party Applications
On the Site, we may provide links to websites or applications maintained by third parties, which we believe you may find useful. Superbio.ai inc. is not responsible for the privacy practices of these other websites or applications and we encourage you to review the privacy policies of each of those other websites or applications before using such websites and applications. Other websites and applications will have different policies and rules regarding the use or disclosure of the personal information you submit to them.
